1. Acceptance of Terms
By accessing and using InkMyPet ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. You must be at least 18 years old to use this Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian.
2. Description of Service
The Service utilizes Artificial Intelligence (AI) algorithms to transform user-uploaded photographs into tattoo-style designs.
No Guarantee of Accuracy: You acknowledge that the designs are generated by an automated system and may contain anatomical, artistic, or structural imperfections.
"As Is" Basis: The Service and the generated images are provided on an "AS IS" and "AS AVAILABLE" basis without any representation or warranty, whether express, implied, or statutory.
3. Intellectual Property & Rights
User Content (Input)
You represent and warrant that you own all rights, title, and interest in and to the photos you upload, or have obtained all necessary permissions and releases to use them. You grant InkMyPet a non-exclusive, royalty-free license to use, reproduce, and process your images solely for the purpose of providing the Service.
Generated Designs (Output)
Upon full payment, InkMyPet assigns to you a perpetual, worldwide, non-exclusive license to use the generated designs for personal and commercial purposes (including tattooing, printing, and merchandise).
Marketing Use
Unless explicitly revoked by you in writing at Contact, InkMyPet reserves the right to use anonymized versions of generated images for promotional purposes (e.g., "Before/After" gallery) on its website and social media channels.
4. Medical and Professional Disclaimer
The designs provided by the Service are digital visual references only.
Not Professional Advice: The Service does not constitute professional artistic or medical advice.
Tattoo Application: You acknowledge that the final result of a tattoo on skin depends heavily on the tattoo artist's skill, skin type, and healing process. InkMyPet is not liable for the quality, appearance, or health consequences of any tattoo based on these designs. You agree to consult with a licensed professional tattoo artist before using any design.
5. Refund Policy and "Soul Guarantee"
At InkMyPet, we stand behind the quality of our AI artistry.
✨ Satisfaction Guarantee: If the generated design does not capture the likeness or spirit of your pet ("The Soul Guarantee"), please contact us at Contact within 7 days of purchase.
Resolution Process: We will offer to regenerate the design at no additional cost using a different photo or style setting.
Refund Eligibility: If, after a revision attempt, you are still not satisfied with the result, we will issue a full refund to your original payment method.
Abuse Prevention: We reserve the right to deny refunds if we detect abuse of the policy (e.g., downloading the high-resolution files and then immediately requesting a refund without valid cause).
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INKMYPET, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
7. Indemnification
You agree to defend, indemnify, and hold harmless InkMyPet and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
8. Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Dispute Resolution: Before filing any claim, you agree to contact us at Contact and attempt informal resolution for at least 30 days.
Arbitration: Any dispute that cannot be resolved informally shall be settled by binding arbitration conducted online, reducing costs for both parties.
Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions.
9. Privacy & Data
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and store your personal data and uploaded images. By using the Service, you consent to such processing as described in our Privacy Policy.
10. Account Termination
InkMyPet reserves the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
11. International Users
The Service is operated internationally. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
